Welcome to FitterPal, a job management platform for window fitting businesses. These Terms of Service ("Terms") govern your access to and use of our website and services at fitterpal.com ("Service").

By accessing or using our Service, you agree that you have read, understood, and accept these Terms and our Privacy Policy. If you disagree with any part of these Terms, please do not use our Service.

FitterPal is designed for business use. You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your business.

Your FitterPal account

Account creation and security

To use FitterPal, you must create an account. You are responsible for:

• Keeping your login credentials secure
• All activities that occur under your account
• Notifying us if you suspect unauthorized access

Multiple users within your organization may access the Service through credentials you manage. You are responsible for controlling who has access and ensuring all users comply with these Terms.

License to use FitterPal

Subject to these Terms, we grant you a limited, non-transferable, non-exclusive, revocable license to use our Service for your window fitting or related business operations.

You may not:

• Resell, rent, lease, or commercially exploit our Service
• Modify, reverse engineer, or create derivative works from our Service
• Use our Service to build a competing product
• Remove copyright or proprietary notices from our Service
• Use our Service in violation of applicable laws

Your content

Ownership and license

Any data, text, images, or other materials you upload to FitterPal ("Your Content") remains your property. This includes customer information, job details, photos, and other business data.

By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it solely for the purpose of providing the Service to you. This includes displaying your data, processing it for reports, and storing backups.

Responsibility for your content

You are solely responsible for your content, including:

• Ensuring you have the right to share it with us
• Ensuring it complies with all applicable laws and regulations
• Obtaining proper consent from customers whose information you share
• Creating and maintaining backups of Your Content

Acceptable use

You agree not to use our Service to:

• Upload or share content that infringes on intellectual property rights
• Upload or share unlawful, harmful, threatening, abusive, or defamatory content
• Upload or share content that is harmful to minors
• Introduce malware, viruses, or harmful code
• Send spam or unsolicited messages
• Interfere with other users' enjoyment of the Service

• Harvest data about other users without consent
• Use automated scripts to generate multiple accounts

We reserve the right to review Your Content and to remove it or suspend your account if we determine, in our sole discretion, that you've violated these Terms.

All intellectual property rights in the Service, including software, designs, text, graphics, logos, icons, and images, are owned by FitterPal. These are protected by UK and international intellectual property laws.

You may terminate your use of the Service at any time by cancelling your subscription and closing your account.

Service availability and changes

We strive to keep FitterPal available at all times, but we do not guarantee uninterrupted access. We may suspend access temporarily for maintenance, upgrades, or other reasons. We are not liable for any downtime.

Changes to the Service

We may modify, update, or discontinue any aspect of our Service at any time. We will make reasonable efforts to notify you of significant changes.

Disclaimers and limitations

FitterPal is provided on an "as is" and "as available" basis. We do not make any warranties, express or implied, regarding the reliability, availability, or suitability of our Service.

Limitation of liability

To the maximum extent permitted by law, FitterPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our Service.

Our total liability for any claims relating to these Terms or our Service is limited to the amount you paid us in the 12 months preceding the claim or £100, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence.

Indemnification

You agree to indemnify and hold FitterPal and its employees, directors, and agents harmless from any claims, demands, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your Content

Dispute resolution

If a dispute arises between you and FitterPal, we encourage you to contact us first to seek a resolution. If we cannot resolve the dispute informally, the following will apply:

Any disputes will be governed by the laws of the United Kingdom. You and FitterPal agree to submit to the exclusive jurisdiction of the courts of England and Wales.

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and FitterPal regarding your use of our Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Updates to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through our Service. Your continued use of FitterPal after such notice constitutes your acceptance of the revised Terms.
